Terms of Service

1. The Platform

Alkfo is a Software-as-a-Service (SaaS) platform that enables businesses to:

• Accept orders from customers via QR code catalogs.
• Manage branches, staff, catalogs, and inventory.
• Process payments and issue ZATCA-compliant e-invoices.
• Access sales analytics and operational reports.

We reserve the right to add, modify, or remove features at any time. Material changes that adversely affect existing functionality will be communicated at least 14 days in advance.

2. Account registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at support@alkfo.com if you suspect unauthorised access.

You must be at least 18 years old and legally authorised to enter into contracts on behalf of your business to register.

3. Subscription and billing

Access to the Platform is provided on a paid subscription basis. By subscribing you authorise us (or our payment processor) to charge the applicable fees on the agreed billing cycle (monthly or annual).

• Trials: If a free trial is offered, it begins on the date of registration. Unless cancelled before the trial ends, your subscription converts automatically to the paid plan you selected.
• Price changes: We will give you at least 30 days' written notice before any price increase takes effect. Continuing to use the Platform after the effective date constitutes acceptance.
• Refunds: Subscription fees are non-refundable except where required by applicable Saudi law or expressly stated in your order.
• Taxes: All fees are exclusive of VAT and any other applicable taxes, which will be added where required by Saudi law.

4. Acceptable use

You agree not to:

• Use the Platform for any purpose that violates Saudi law or regulation.
• Upload, transmit, or display content that is unlawful, defamatory, obscene, or infringes any third-party intellectual property rights.
• Attempt to probe, scan, or test the vulnerability of the Platform or circumvent any security mechanism.
• Use automated scripts, bots, or scrapers to access the Platform without our prior written consent.
• Resell, sublicense, or otherwise provide access to the Platform to third parties without our authorisation.

We may suspend or terminate your account without notice if we reasonably believe you have breached this section.

5. Your content

You retain ownership of all content you upload to the Platform (menus, images, pricing, etc.). You grant us a limited, worldwide, royalty-free licence to host, store, display, and transmit that content solely to provide the Platform services.

You warrant that your content does not violate any applicable law or third-party rights, and you are solely responsible for its accuracy and legality.

6. Intellectual property

All rights, title, and interest in and to the Platform — including software, design, trademarks, and documentation — are and remain the exclusive property of Alkfo. These Terms do not transfer any intellectual property rights to you. You may not copy, modify, or create derivative works from any part of the Platform.

7. Service availability

We aim to maintain high availability but we do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. We are not liable for losses arising from downtime caused by circumstances beyond our reasonable control (force majeure).

8. Limitation of liability

To the maximum extent permitted by applicable law:

• The Platform is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement.
• Our total aggregate liability to you for any claim arising under or related to these Terms shall not exceed the fees you paid to us in the three (3) months preceding the event giving rise to the claim.
• We shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits or data.

9. Termination

By you: You may cancel your subscription at any time from your account settings. Access continues until the end of the current billing period.

By us: We may suspend or terminate your account for breach of these Terms, non-payment, or if required by law. We will give reasonable notice except where immediate termination is necessary to protect the Platform or other users.

Effect of termination: Upon termination you may export your data for 30 days using the platform's export tools. After that period we may delete your data, subject to any retention obligations under Saudi law and ZATCA regulations.

10. Confidentiality

Each party agrees to keep the other's confidential business information (including pricing, technical architecture, and customer data) strictly confidential and not to disclose it to third parties without consent, except as required by law.

11. Governing law and disputes

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising out of or in connection with these Terms shall first be referred to good-faith negotiation. If unresolved within 30 days, it shall be submitted to the competent courts in the Kingdom of Saudi Arabia.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to you by email at least 14 days before the effective date. Continued use of the Platform after the effective date constitutes your acceptance of the revised Terms.
